Meet the Author – Montserrat Miller
I began my career as a trial attorney with the Immigration and Naturalization Service handling, among other cases, employer sanctions matters. Over the years I’ve worked in private practice and on Capitol Hill as counsel to Senator Dianne Feinstein on the Senate Judiciary Committee. I am now a partner in Arnall Golden Gregory’s Privacy and Consumer Regulatory, Immigration and Global Migration, and Government and Regulatory practices.
I have a dual practice, meaning I advise clients on privacy and data protection-related matters, including counseling and defending companies regarding their compliance under the Fair Credit Reporting Act (FCRA), Driver’s Privacy Protection Act, Gramm-Leach-Bliley Act, Ban the Box ordinances and state data breach statutes AND I counsel and defend companies regarding their hiring practices and compliance with the Form I-9 and E-Verify employment eligibility verification requirements. Which means I defend employers in civil and criminal workplace enforcement matters, conduct immigration-related internal investigations and I-9 audits, and conduct due diligence regarding Form I-9 issues during mergers and acquisitions.
Back to background screening, my practice includes a special emphasis on the use of criminal and credit history information and compliance with the FCRA, Title VII of the Civil Rights Act of 1964 and state/local laws and ordinances (e.g., Ban the Box) which impact the use of background checks for employment screening and tenancy purposes. I represent both consumer reporting agencies and end-users of consumer reports. I am co-chair of the firm’s Background Screening Industry Group.
